Welcome to BINGO AQUATIC SOLUTIONS. These Terms of Use ("Agreement") constitute a legally binding agreement between Bingo Aquatic Solutions Pte. Ltd. ("Bingo Aquatic Solutions", "we", "us", "our"), a company incorporated in Singapore, and you ("User", "you"), governing your access to and use of the bingoaquaticsolutions.sg website, including all subpages, and any associated platforms, applications, or services (collectively, the "Platform") and the services offered thereon (the "Services").

By accessing or using any part of the Platform or Services, or by creating and maintaining an account with Bingo Aquatic Solutions, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions of this Agreement, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms, you must not use the Platform or Services.

Bingo Aquatic Solutions reserves the right to modify or update this Agreement at any time, with or without prior notice. Any such modifications will be effective immediately upon posting on the Platform. Your continued use of the Services or maintenance of an account with Bingo Aquatic Solutions after any such modifications shall constitute your unequivocal acceptance of the revised Agreement and your consent to abide by its terms. We encourage you to review this Agreement periodically for any changes.

SERVICE LICENSE
Subject to your compliance with the terms and conditions of this Agreement, Bingo Aquatic Solutions hereby grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Platform and the Services solely for your personal, non-commercial use. You acknowledge and agree that you obtain no rights other than the specific rights and licenses expressly granted herein. Bingo Aquatic Solutions reserves the right to modify, upgrade, suspend, or discontinue any or all of the Services, the Platform, or any features thereof, at any time, with or without notice, at its sole discretion. All rights not expressly granted to you under this Agreement are exclusively reserved by Bingo Aquatic Solutions and its licensors.

ACCOUNT REGISTRATION AND MANAGEMENT
To access certain Services, you are required to create and maintain an account with Bingo Aquatic Solutions. Account creation is free of charge and requires you to provide accurate and complete details as requested. The availability and use of your account and the Services, including any opportunities to earn incentives, are offered at the sole discretion of Bingo Aquatic Solutions and are strictly subject to your ongoing compliance with this Agreement.

Account Restrictions:
An individual shall not create, control, or have custody over multiple Bingo Aquatic Solutions accounts. Specifically:
- Each unique mobile number may only be linked to one Bingo Aquatic Solutions account.
- Each unique email address may only be linked to one Bingo Aquatic Solutions account.
- Each unique payment account (e.g., bank account, PayPal account) may only be linked to one Bingo Aquatic Solutions account.

Account Suspension and Termination:
Any failure to adhere to these terms and conditions, any engagement in fraud or abuse related to the accrual or receipt of incentives, and/or any misrepresentation of information furnished to Bingo Aquatic Solutions or its affiliates may result in your Bingo Aquatic Solutions account being flagged for suspicious activity, and subsequently suspended or terminated. In such instances, any accumulated incentives may be forfeited.

Account Monitoring and Discrepancies:
You are solely responsible for regularly checking your account to ensure that incentives have been properly credited and that your account balance is accurate and up-to-date. You must notify Bingo Aquatic Solutions of any omissions, incorrect entries, or discrepancies concerning any transaction within thirty (30) days following the date of such transaction. Bingo Aquatic Solutions reserves the right not to correct any omissions, incorrect entries, or discrepancies brought to its attention after this thirty (30) day period.

EARNING INCENTIVES
Among the Services offered by Bingo Aquatic Solutions is the opportunity to earn incentives on eligible purchases made through our various Platform channels. Creating and maintaining an active account with Bingo Aquatic Solutions is a prerequisite for earning incentives. The crediting of incentives is also subject to various terms, conditions, and requirements, both express and implied, associated with the general crediting of incentives or specific promotional offers. These terms, conditions, and requirements include, but are not limited to, the following:
- Requiring the user to have cookies enabled throughout the entire Browse session when accessing the Platform.
- Prohibiting the opening of separate tabs or browsers while accessing the Platform for eligible transactions.
- Prohibiting engagement in any fraudulent or dishonest conduct, and requiring strict adherence to the terms of this Agreement and any other terms and conditions stipulated by Bingo Aquatic Solutions.

Additionally, certain purchases may be explicitly excluded from incentive eligibility. Generally, incentives are earned on the net purchase amount, excluding any administrative fees. However, incentive amounts and exclusions vary significantly among merchant partners, and individual advertisements or promotions may contain specific exclusions. You are advised to review these terms carefully. These exclusions are subject to change without prior notice, and Bingo Aquatic Solutions expressly disclaims any and all liability in connection with any incorrect information or failure to include information on the list of exclusions. Examples of typical exclusions include (but are not limited to):
- Incentive eligibility only upon the successful completion of the entire purchase process.
- Different tiers of eligible incentives for various user categories (e.g., differentiated incentive rates for new versus existing users).

MERCHANT PARTNER POLICIES
Any products or services purchased from any third-party merchant partner, whether initiated through the Platform or otherwise, are exclusively governed by and subject to the applicable merchant partner’s policies and terms and conditions. This includes, but is not limited to, their respective return, cancellation, exchange, and shipping policies. You acknowledge and agree that Bingo Aquatic Solutions acts solely as an intermediary and is not an agent of any merchant partner. Each merchant partner operates independently and is not under the control or supervision of Bingo Aquatic Solutions. Accordingly, your participation in any offers or promotions, or your direct correspondence with any merchant partner, is solely a matter between you and that specific merchant partner. Bingo Aquatic Solutions assumes no liability, obligation, or responsibility for any aspect of such correspondence, offer, or promotion, including, without limitation, the withdrawal or modification of any such offer or promotion by the merchant partner. Bingo Aquatic Solutions is not responsible for any changes to, or discontinuance of, any merchant partner from the Platform, or the termination of any promotion offered by any merchant partner on the Platform, or for any effect on the accrual of incentives caused by such changes, discontinuance, or withdrawal. Bingo Aquatic Solutions assumes no responsibility and shall not be liable for the content, products, and/or services offered on any merchant partner's platforms (including, but not limited to, the quality, merchantability, or fitness for a particular purpose of such products or services, or assurance that such content, products, and/or services do not infringe upon any applicable laws or regulations).

ADJUSTMENTS AND DEDUCTIONS
Bingo Aquatic Solutions reserves the right to make top-ups and deductions from the balance in a user’s account where it deems necessary, reasonable, or expedient to do so. This includes, but is not limited to, situations where incentives have been incorrectly credited into a user’s account, and/or where a user is found to have acted fraudulently, dishonestly, or in contravention of the terms of this Agreement.

REDEEMING INCENTIVES
You may redeem your accumulated incentives at any time, subject to the terms and conditions of this Agreement and any specific conditions related to individual incentive entries in your account. To be eligible for redemption, you must have accumulated incentives equal to or exceeding the minimum redemption amount communicated by Bingo Aquatic Solutions from time to time. To process a redemption, you must maintain an active account and provide the minimum relevant information required (e.g., a valid bank account number).

NATURE OF INCENTIVES
For the avoidance of doubt, you do not acquire any proprietary right or beneficial interest over any monies or assets held by Bingo Aquatic Solutions when you earn incentives in your account. The incentives accrued in your account do not constitute monies held in trust by Bingo Aquatic Solutions for your benefit. Your rights and entitlements are solely limited to such personal or contractual rights of repayment as may arise out of this Agreement.

ACCOUNT TERMINATION AND EXPIRY
Incentives accumulated in your Bingo Aquatic Solutions account shall expire if your account remains inactive (i.e., no eligible purchases are made through the Platform) for a continuous period exceeding twelve (12) months.

Bingo Aquatic Solutions reserves the right to suspend or terminate your account in accordance with Section 12 (Fraud) or where it is necessary or reasonable to do so to comply with or satisfy any applicable law, regulation, or court order.

PERSONAL DATA PROTECTION
The collection, use, processing, and disclosure of your Personal Data are subject to our Privacy Policy, which is hereby incorporated by reference and is accessible on the Platform. By using the Services, you consent to such collection, use, processing, and disclosure in accordance with our Privacy Policy.

TAXES
You are solely responsible for any and all taxes, duties, or other governmental charges that may apply to amounts earned from the incentives you have redeemed. Bingo Aquatic Solutions makes no representation or warranty regarding the tax treatment of such amounts.

FRAUD
Bingo Aquatic Solutions may suspend or terminate your account immediately if it has reason to believe you are involved in any fraudulent, dishonest, or unauthorized activities. Any failure to comply with this Agreement, any act of fraud, dishonesty, or abuse relating to the use of the Services or your account, or any misrepresentation of any information furnished to Bingo Aquatic Solutions or its affiliates by you or anyone acting on your behalf, may result in the immediate termination of your account and the forfeiture of all accrued incentive rewards.

THIRD-PARTY RIGHTS
Unless expressly provided otherwise in this Agreement, a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 2001 or any equivalent legislation to enforce any term of this Agreement.

COMMUNICATIONS
By creating a Bingo Aquatic Solutions account, you consent to receive communications from us. These communications may include account and user-related notifications (e.g., confirmation of incentive credits) as well as periodic electronic communications highlighting new offers, coupons, or special deals available to Bingo Aquatic Solutions users. We may communicate with you regarding your account via electronic communications or direct mail using the information you provide during the registration process. Your consent to receive electronic communications includes any notices or other information that we may be required by law to provide you in writing or otherwise. You agree to keep us appraised of your current email address should it change after you become a Member. We may also send you push notifications if you install our mobile application.

OWNERSHIP AND INTELLECTUAL PROPERTY
All rights, title, and interest in and to the Services, the Platform, and the Content (including all text, graphics, images, software, and other materials) associated with or displayed on the same belong exclusively to Bingo Aquatic Solutions or its licensors. Additionally, Bingo Aquatic Solutions shall maintain all rights, title, and interest in "Bingo Aquatic Solutions", the Bingo Aquatic Solutions logo, and any other marks, service marks, trademarks, or logos of Bingo Aquatic Solutions (the “Bingo Aquatic Solutions Marks”) that are registered in Singapore and other jurisdictions.

The Bingo Aquatic Solutions Marks may not be used in connection with any non-Bingo Aquatic Solutions product or service in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Bingo Aquatic Solutions. You are strictly prohibited from bidding on, applying for, registering, owning, or controlling any keywords or marks containing "Bingo Aquatic Solutions" or anything substantially similar to "Bingo Aquatic Solutions" or any other Bingo Aquatic Solutions Mark, including, without limitation, https://www.google.com/search?q=bingoaquaticsolutions.com, bingoaquaticsolutions.sg, https://www.google.com/search?q=bingoaquaticsolutions.com.sg, or bingoaquaticsolutions.asia, with any search engine, domain service provider, or any intellectual property office whatsoever. You shall not mention or use "Bingo Aquatic Solutions" in any advertisement text, extension, or banner ad without the express prior written consent of Bingo Aquatic Solutions. All other trademarks not owned by Bingo Aquatic Solutions that are used in providing the Services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Bingo Aquatic Solutions.

COMMUNITY STANDARDS AND CONDUCT
By creating a Bingo Aquatic Solutions account, you become a member of a community that relies on the goodwill and responsible behavior of each user. Users are expressly prohibited from the transmission or communication of images or text constituting ethnic slurs, obscenities, sexually explicit material, inflammatory or derogatory comments, or anything else that may be construed as harassing or offensive. This prohibition applies to any content targeted at the Services, the Platform, our employees, contractors or agents, our merchant partners, or other users. This includes communications by means of social media or other internet posts which violate the above community standards or promote or encourage gaming or fraudulent behavior. Users who violate this provision, as determined by us in our absolute discretion, may have their accounts suspended or terminated without prior notice.

INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bingo Aquatic Solutions, any merchant partners, as well as their respective officers, directors, employees, successors, agents, and affiliates, from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with: (a) your breach of this Agreement; or (b) any materials in any form whatsoever that are provided by you (or through your username and/or password) in connection with the Services or Platform. You agree to cooperate as fully as reasonably required in our defense and/or settlement of any such claim. We reserve the right, at our own expense and in our reasonable discretion, to assume exclusive control over the defense and settlement of any matter otherwise subject to indemnification by you.

WARRANTY DISCLAIMER
THE SERVICES, CONTENT, AND THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY AS TO THE QUALITY, ACCURACY, CURRENTNESS, COMPLETENESS, RELIABILITY, OR VALIDITY OF THE SERVICES, CONTENT, OR THE PLATFORM, INCLUDING, WITHOUT LIMITATION, ANY PRODUCT SEARCH RESULTS, PRODUCT DESCRIPTIONS, PRODUCT AVAILABILITY, PRICING INFORMATION, ADVICE, OPINION, STATEMENT, RECOMMENDATIONS, OR OTHER INFORMATION DISPLAYED, UPLOADED, OR DISTRIBUTED IN CONNECTION WITH THE SERVICES. BINGO AQUATIC SOLUTIONS DOES NOT WARRANT THAT THE FUNCTIONALITY OF THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FURTHER, BINGO AQUATIC SOLUTIONS DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OF, OR ACCURACY OF ADVERTISEMENTS FOR, ANY PRODUCTS OR SERVICES OFFERED OR PROVIDED BY ITS AFFILIATE STORES IN CONJUNCTION WITH THE SERVICES. YOUR USE OF THE SERVICES AND THE PLATFORM IS AT YOUR SOLE RISK.

ASSIGNMENT
You may not assign your rights and obligations under this Agreement, in whole or in part, without the prior express written consent of Bingo Aquatic Solutions. Any attempted assignment without such consent will be null and void and of no legal effect.

GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles. Any dispute, controversy, or claim arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the Courts of Singapore, to whose exclusive jurisdiction you irrevocably submit.

HEADINGS
The headings used in this Agreement are for convenience and reference purposes only and shall not affect the interpretation or construction of any provision herein.

WAIVERS / SEVERABILITY
Any failure by Bingo Aquatic Solutions to enforce any provision of this Agreement on any occasion shall not be deemed a waiver of that provision or of our right to enforce it on a future occasion. Any waiver of any provision of this Agreement by Bingo Aquatic Solutions on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion. If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

ENTIRE AGREEMENT
This Agreement, together with the Privacy Policy and any additional terms and conditions expressly referred to herein or generally displayed on the Platform, represents the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements, negotiations, and representations, whether written or oral (including, without limitation, earlier versions of this Agreement that may have been accepted by you). We reserve the right to modify this Agreement at any time. Your continued use of any of the Services or continued maintenance of an account with Bingo Aquatic Solutions shall constitute and be deemed to be your acceptance of such modification and your consent to abide by any terms thereof.
